PRICES

All prices are in Canadian dollars unless otherwise indicated. Prices are subject to availability and valid if booked by dates indicated. Prices include all taxes, fees and service charges. Prices may vary due to an increase in the exchange rate or a fuel surcharge imposed by carrier, cruise line transportation company or hotel. Prices are valid at time of posting and for the dates indicated. Tourcan Vacations’ allotted space and special group rates are subject to recall at any time. Tourcan Vacations and Kennedy Professional Educational Seminars Inc. (KPES) shall not be liable for any fluctuation in price or change in schedule or equipment or accommodations for any travel booking or travel service to be provided by a Travel Supplier. Tourcan Vacations and KPES disclaim all liability for errors or bias in reservations, fares, or other information provided by any automated airline or other reservation system.

U.S. CREDIT CARD PROCESSING

Tourcan Vacations Canada is the dedicated travel agency for KPES trips. Deposits are processed for the Canadian amount shown, and exchanged at a daily rate used by your credit card company. Your final charges will be put through in Canadian funds, and will convert to U.S. Your charges are guaranteed to be the same as or lower than the US prices shown in brochure if booked by the deadline shown. Credit card charges for exchange fees are the responsibility of the cardholder.

DOCUMENTATION

A valid passport is required for Canadian and U.S. citizens to all destinations. If you are returning to Canada with a passport from another country, you will also need a permanent resident card. If your citizenship is not in Canada or the U.S., please check for further documentation requirements.

GRATUITIES

Tourcan Vacations includes pre-paid gratuities in the package price of all cruise or tour package price (unless otherwise indicated) for cruiseline dining room staff, cabin attendants, tour directors and drivers wherever possible for your convenience. Gratuities are not included for local tour guides or services that are not outlined in your travel documents

TERMS AND CONDITIONS

Please refer to the cruise line or tour company brochures for detailed terms and conditions. Cruise itineraries are subject to change. KPES hosts are not responsible for personal care. Prices are guaranteed until booking deadlines shown as long as group inventory is available. Group inventory could sell out, and is subject to a recall in sold out situations, at which time current pricing comes in to effect. Book early to avoid these situations.

GROUP NEGOTIATED RATES & CHANGE FEES

Please note, our rates are negotiated based on inclusive group costs for hotels, tours etc. Should individuals request specific changes that deviate from the negotiated group program, additional change fees may apply. No refunds will be given for any unused services/products, etc. which are part of the negotiated package.

See specific departures or consult with Tourcan Vacations regarding the cancellation penalties and amounts. If not shown, travellers will be advised of payment terms and cancellation/change penalties at time of booking.

LEGAL NAMES/COPY OF PASSPORT

Tourcan Vacations requires legal names (first, middle names, and last name) as they appear on your passport at time of booking. Legal names are required for your cruise, land and air transportation documents. There will be a $50 charge, plus any fees applied by the airlines and cruise lines for name corrections after final payment. Some air and cruise itineraries may not permit name changes. You may be denied boarding if your passport name does not match your reservation.

CRUISE, TOUR, AND AIR DOCUMENTS

Final travel documents, confirmations and trip details will be provided to you approx. two to three weeks prior to your departure.

DOCUMENTATION/MEDICAL REQUIREMENTS

We recommend your passport is valid for at least 6 months beyond your return date. Your passport must be in perfect condition. Passports that are ripped, torn, missing corners, have water damage to either the cover and/or inside pages, or stained, may not be accepted by the airline carrier or Immigration. Landed immigrants will require a Permanent Resident Card to return to Canada. Additional documentation may be required for non-Canadian residents. Travel immunizations should be up-to-date (i.e. tetanus, diphtheria, polio, typhoid, hepatitis etc). Travellers should contact a doctor, Public Health or Travel Clinic a minimum of eight weeks prior to departure from Canada to obtain further information and to receive necessary immunizations. Canadian citizens will be advised if visas are required for your itinerary at time of booking or final payment. Citizens of other nationalities are responsible to ensure all travel documentation is in order.

GRATUITIES

All Celebrity Cruise departures in this brochure have gratuities included to stateroom attendant, waiter, assistant waiter, and headwaiter. Shipboard Beverage Gratuities: An 18% gratuity will be added to wine and bar purchases onboard. Please inquire if gratuities are included for any other departures offered.

HOTEL DISCLAIMER

Hotels used will be at least a standard/four star rating or higher. Hotel names listed for pre-cruise stays may change based on availability. Hotel ratings vary by country.

PROMOTIONS

Cruise lines and tour operators may offer promotions from time to time. Promotions are only available on new bookings during promotion periods. See terms and conditions specific to those promotions for further details. Promotional offers and pricing are subject to change and only guaranteed once deposit is made.

NOT INCLUDED

Visa and passport costs, immunizations, flights, transfers and items of a personal nature such as laundry, phone, shore excursions. Meals are not included for land portions of advertised itineraries unless otherwise noted. Alcoholic beverages are not included unless Celebrity’s Classic Beverage Package is included as part of your reservation.

TRAVEL ARRANGEMENTS

If you require assistance during travel we recommend asking a travelling companion to accompany you. Please advise your Tourcan Vacations travel advisor of any medical requirements or allergies at time of booking. For hosted departures, Tourcan Vacations’ and KPES hosts are along to assist you with any concerns or to answer any questions about the cruise or tour during the cruise or tour. Hosts cannot be responsible for individual care. If you require, or your doctor recommends special assistance during travel please make arrangements. Tourcan Vacations reserves the right to refuse a booking should we evaluate some of the trip components will be too difficult to manage for the traveller. Tourcan Vacations and KPES hosts cannot be held responsible for any circumstances shown in Disclaimer/Indemnity below. Fares are capacity controlled & subject to availability. Itineraries, hotel and any land program/shore excursions being offered are subject to change. Tourcan Vacations’ inventory for tours, cruises, air and other components is subject to supplier recall at any time.

FORCE MAJEURE

Tourcan Vacations and Kennedy Professional Educational Seminars shall not be held liable for any delay or failure to perform its obligations hereunder caused by circumstances beyond its reasonable control including, without limitation, strikes, fires, acts of God, any form of government intervention, including business restrictions and prohibitions under territorial or extraterritorial economic or trade sanctions whether determined by national or foreign governments or international institutions. If legally permitted, the performance of such obligations shall be suspended only for such time as such circumstances last.

DISCLAIMER/INDEMNITY

In offering travel arrangements for sale, Tourcan Vacations acts only as an agent. Tourcan Vacations, KPES and their appointed hosts maintain no control over the personnel, equipment or operations of any supplier and assumes no responsibility for, and shall not be expected, asked or required to pay for any financial loss, personal injury, property damage, other loss, accident, delay, inconvenience or irregularity which you may experience either by reason of (1) non performance by any supplier for whatever reason; (2) wrongful, careless, negligent or unauthorized acts or omissions on the part of any supplier or its employees or on the part of any other party not under the control of Tourcan Vacations or KPES; or (3) any defect, breakdown, or other failure of any aircraft, train, automobile, ship, accommodation, or other equipment or instrumentality owned, operated or otherwise used by a supplier. Other terms and conditions of your travel arrangements may be outlined in the supplier’s brochure and your travel documents and you should read them carefully. Availability of refunds for unused travel reservations will vary with the type of reservations and the point your money immediately belongs to the supplier. In the event of any bankruptcy, you should seek refunds directly from your credit card company, the supplier, its bankruptcy trustee or the applicable provincial compensation fund, if any. If a Travel Supplier defaults prior to providing any travel service for which payment has been made by Tourcan Vacations to such Travel Supplier, the Traveller’s sole recourse for refund shall be with the defaulting Travel Supplier, its own insurer or any industry protective fund. With respect to trust accounts, Tourcan will abide by all TICO (Travel Industry Council of Ontario) regulations.

During your travel, photographs and videos of activities and attendees including you may be taken by KPES and Tourcan Vacations. You agree on behalf of yourself as well as your personal representatives, heirs, successors, assigns and anyone else claiming by or through you to waive any claim and not to institute any claim or other legal action against KPES and Tourcan Vacations related to the photos and videos arising from or in connection with your trip.

In the event that such a claim or legal action is instituted, you agree to indemnify and hold harmless KPES and Tourcan Vacations by voluntarily agreeing to pay all costs and legal fees it incurs if such claim is withdrawn or if a court determines, for whatever reason, including the enforceability of this Disclaimer/Indemnity provision, that KPES and/or Tourcan Vacations is not liable for the injury, loss or damage alleged.

IMAGES AND MARKETING

Unless you advise us otherwise during registration, you agree that while participating in any trip through KPES and Tourcan Vacations, images, photos or videos may be taken by KPES, Tourcan Vacations or their representatives which may contain or feature you or your likeness. You consent to any such pictures being taken.

You also consent to granting a perpetual, royalty-free, worldwide, irrevocable license to the KPES and Tourcan Vacations, their contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

You acknowledge that other participants on the trip may take photos or videos that may contain you. KPES and Tourcan Vacations are not responsible for passengers who may take your photograph or video you without our knowledge.

If you do not wish for your photograph to be taken at any time, or to be included in any video, please let your trip leader/host know.

REGISTRATION AND TUITION

Seminar registration/tuition costs are as noted on the Kennedy Seminar website, on the appropriate page(s) of each CE/ vacation destination. Any discrepancy between the Kennedy Seminar website page denoting the CE /vacation seminar fees, and any printed material, email blast, internet marketing or promotional material, verbal communication from Kennedy Seminars or Tourcan Vacations or any of its’ employees, the seminar registration fees denoted on the website  will be deemed to be the accurate version.

Kennedy Seminar registration fees will be collected when the final payment for that particular vacation is due.  {Kennedy travellers will be notified as part of the travel information, when the final payment for the vacation/holiday is due.}

If a Kennedy traveller cancels after the final payment is made, the tuition paid for the Kennedy seminar will be fully refunded.  The issue of potential  or perceived reimbursement for travel related costs following a cancellation must be discussed with the travellers cancellation insurance ( if applicable ) and Tourcan Vacations.

Seminar fees – partial reimbursement –  related to Kennedy’s “Refer a friend program” is noted on the website under the “Refer a friend” program page.

LIABILITY

Kennedy Professional Educational Seminars Inc. and Tourcan Vacations are not responsible for any claims, losses, damages, cost or expenses arising out of personal injury, accidents or death, loss, damage or delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental resulting from but not restricted to any of the following: *sickness, theft, labour disputes, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control; * your failure to obtain the documentation required for your trip such as birth certificates and photo ID for Canadian citizens, (in which case you will also not be entitled to any refund) * your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in and check-out times; * cancellation or change for any reason in the travel services advertised. Kennedy Professional Educational Seminars, Inc. makes every attempt to deliver lectures as advertised. We can not assume any responsibility for dental lectures that must be substituted or do not take place on the corresponding holiday, as a result of the lecturer being unable to be present, in either a ‘live’ format or an internet format, for whatever reason to include but not be limited to, medical illness of self, or family, or travel companion or death.
